In an Associated Press article found at Foxnews.com, Washington State is suing Secure Computer LLC and six people over spyware for distributing "Spyware Cleaner". Paul E. Burke and Gary T. Preston are two folks from Secure Computer LLC who are charged. They have made more than $100,000 since the Summer of 2004 pitching their spyware and spam to unsuspecting users. State Attorney General Rob McKenna said Tuesday night that this is the first lawsuit filed under Washington state's new anti-spyware act, which the Legislature passed last year, and one of the first spyware lawsuits in the country.
"Deceived into believing that dangerous spyware is on their computer and there is no time to waste, the user is induced to purchase Spyware Cleaner," the lawsuit said.
The article goes on to mention and links to a CastleCops thread as evidence: "Some of the spam and pop-up ads sent on behalf of Secure Computer imitated Microsoft Corp. messages and products, the lawsuit said. Microsoft has pursued more than 100 anti-spam lawsuits, winning more than $800 million from spammers."
Others named in the lawsuit (to which phone calls were not returned): Burke's wife, Wendy; Seth T. Traub of Portsmouth, N.H.; Zhijian Chen of Portland, Ore.; and Manoj Kumar of Maharashtra, India.
The lawsuit cites CAN-SPAM, several state and federal laws, and may be entitled to millions of dollars in damages. Spyware Cleaner is a known rogue application.
